Privacy policy

MixUp Nutrition LLC (“MixUp Nutrition,” “we,” “us”) operates mixupnutrition.com. This policy explains how we process personal data, including when you visit from the European Economic Area (EEA), the UK or Switzerland.

If we offer this site to people in the EEA on a regular basis, we may need to appoint an EU representative under GDPR Article 27. That contact will be added here if appointed.

What we collect

• Contact inquiries: name, business email, company, subject and message if you submit the form or email us.
• Technical logs: IP address, browser, device and pages requested, collected by our host (Cloudflare) to operate and secure the site.
• Cookie preference: your accept/reject choice, stored in your browser (strictly necessary).
• Approximate country: used only to decide whether a cookie banner is required (EEA, UK and Switzerland). Looked up via Cloudflare or a country API; not used for advertising.
• Analytics: page views, clicks, errors and session recording via PostHog EU. In the EEA/UK/Switzerland this runs only after you opt in. Elsewhere it may run without a banner. Google Analytics 4 is used only if a measurement ID is configured.

Legal bases (GDPR)

• Contact form and follow-up: Article 6(1)(b) (steps prior to a contract) and/or Article 6(1)(f) (legitimate interest in answering business inquiries).
• Hosting, security and cookie-preference storage: Article 6(1)(f) and, for strictly necessary cookies, the ePrivacy exemption.
• Analytics (including session recording) in the EEA/UK/Switzerland: Article 6(1)(a) — consent. Outside those regions we rely on legitimate interests in understanding how the site is used (Article 6(1)(f)), and you can still opt out via Cookie settings.
• Legal obligations: Article 6(1)(c) where applicable.

We do not sell personal data or use it for advertising profiles.

Processors

• Cloudflare — hosting, CDN and security.
• FormSubmit — delivers contact-form messages to our email.
• PostHog (EU Cloud, eu.i.posthog.com) — product analytics, error tracking and optional session replay, only after you accept. Form fields in recordings are masked. Person profiles are created only if you submit the contact form.
• Google LLC — Google Analytics, only if a measurement ID is configured and you accept analytics cookies. Advertising features and Google Signals are disabled.

International transfers

We are established in the United States. PostHog analytics for this site is hosted in the EU. Cloudflare, FormSubmit and Google may process data in the US or other countries. Where GDPR applies, transfers rely on an adequacy decision (including the EU-US Data Privacy Framework where the provider is certified) and/or Standard Contractual Clauses.

Retention

• Inquiries: as long as needed to handle the request and keep ordinary business records (typically up to 3 years unless a longer period is required).
• Server logs: according to Cloudflare’s default log retention.
• Analytics and session recordings: according to PostHog project retention (and Google Analytics, default 14 months, if configured) if you consented.
• Cookie choice: until you clear site data or change the choice.

Your rights

If GDPR or UK GDPR applies, you may request access, rectification, erasure, restriction, portability, and objection to processing based on legitimate interests. Where we rely on consent, you may withdraw it at any time without affecting prior lawful processing. You may also lodge a complaint with your local supervisory authority (for example your national data-protection authority, or the ICO in the UK).
